Please read these Terms of Use ("Terms", "Terms of Use") carefully before using the PriceKit application (the "Service") operated by Patricio Guzman ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and Apple’s standard Licensed Application End User License Agreement (EULA). If you disagree with any part of the terms, then you may not access the Service.

2. Accounts and Security

To use certain features of the Service (e.g., synchronization), you may need to be signed in with your Apple ID.

• Responsibility: You are responsible for safeguarding the credentials (like App Store Connect API keys) that you use to access the Service.
• Liability: We cannot and will not be liable for any loss or damage arising from your failure to comply with security obligations or from the compromise of your local device/iCloud account.

3. Professional Use & Disclaimer

• Accuracy: While we strive to provide accurate data (e.g., Purchasing Power Parity indexes like the "Netflix Index"), we do not guarantee the accuracy, completeness, or timeliness of this data.
• Decision Making: You acknowledge that all pricing decisions are your sole responsibility. We are not liable for any revenue loss, pricing errors, or inconsistencies on your App Store Connect account resulting from the use of this Service.
• "As Is" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

4. Subscriptions and Purchases (Pro Version)

If you purchase a "Pro" subscription:

• Billing: Payments will be charged to your Apple ID account at the confirmation of purchase.
• Renewal: Subscription automatically renews unless strictly canceled at least 24 hours before the end of the current period.
• Features: Pro access includes unlimited pricing changes, unlimited apps management, and priority support.
• Refunds: All refund requests are handled directly by Apple in accordance with their refund policy.

5. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Patricio Guzman.

6. Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

7. Limitation of Liability

In no event shall Patricio Guzman, nor his partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of France, without regard to its conflict of law provisions.

9. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
